Dominate ability can tick after player is already dead at least once

While trying to dominate a werewolf in Dunley Farmlands, the werewolf killed me, then the dominate finally ticked, capturing the werewolf, but since I was dead the game just killed the werewolf, precluding any ability to try again.
I've been killed by a dominated character from fire damage from the fight before, but this instance seemed like something that shouldn't happen.
This occurs on a Private Server, where my friend is the host.
